METHOD & TERMS

Acreages in this advertisement are estimated. A survey will be completed prior to the closing on all tracts. All tracts will be sold on a price per acre basis, based on the acreages obtained from the completed survey. Said surveyed acres will be used to constitute the final settlement price. Tracts 1 & 2 will be offered through the marketing method of "Buyers Choice", wherein the high bidder can purchase (in any order) any or all of the Tracts 1-2 for their high bid.

 

The property will NOT be offered in its entirety at the conclusion of the auction.

Immediately following the auction, the successful bidder(s) will be required to enter into a written purchase agreement with the seller and pay ten percent (10%) of the bid price as a non-refundable down payment, payable to Staton Abstract & Title Co., which shall hold the money in escrow until closing.

The balance of the bid price will be due at the time of closing on or before October 30, 2020 which will take place at Staton Abstract & Title Co. The sale will NOT be contingent upon receiving financing or any other contingencies. Title insurance in the full amount of the purchase price will be provided by the seller. The 2020 real estate taxes will be prorated to the date of closing. The 2021 & all subsequent real estate taxes will be paid by the buyer(s). Closing costs will be divided equally between buyer(s) & seller. Possession will be transferred to buyer at the time of closing.

Updated 9/29/20: The property will be sold subject to the exceptions listed in the title report prepared by Staton Abstract which is available for review. One of the exceptions listed an Oil and Gas Lease dated October 19, 1950 and a copy of said lease is available for review.  Because the title company will consider this lease an exception in it's title insurance commitment, we cannot insure title over it, however, Seller will provide the successful bidder an affidavit stating that there has been no oil and gas production on the property since Seller's family acquired title to the property in 1970 and that no lease payments have been received by Sellers from the lessee named in that lease during that time.
