TRACT INFORMATION

Tract 1 - 161.9 Surveyed Acres 

Tract 1 represents productive farmland currently used as improved pasture and hay production with the remaining balance in ponds, timber, and timbered draws. FSA figures should indicate approximately 115.8 tillable acres predominantly consisting of Greenton, Colo, and Armster loams with 0 to 2 and 5 to 9 percent slopes. Access to this farm can be made from the south by CR 190 or by the west by CR 101. Tract is also improved with 5 ponds, a nice 30’x60’ machine shed with a 16’x60' open-side lean-to, and a 30’x60’ hay shed. Electric and rural water services are available. Tract 2 - Home & 4.4 Surveyed Acres

METHOD & TERMS

Sale Method: A survey has been completed prior to the sale on both tracts. Tract 1 will be sold on a price per acre basis, based on the acreages obtained from the completed survey. Said surveyed acres will be used to constitute the final settlement price. After Tract 1 has been sold, we will then sell Tract 2 for a “lump sum” or total dollar amount. Property will be sold in as-is condition and is not contingent upon buyer's financing, condition of property, appraisal, inspection, or any of contingencies. The tracts will NOT be offered together at the conclusion of the auction.

Purchase Agreement: At the conclusion of the auction, the successful bidder(s) will be required to enter into a written purchase agreement with the seller and pay ten percent (10%) of the bid price as a non-refundable down payment, payable to Harvest & Home Tile Co. (Formerly Carroll County Title Company), which shall hold the money in escrow until closing.

Closing: The balance of the bid price will be due at the time of closing in approximately 30 days, on or before Monday, April 3, 2023, which will take place at Harvest & Home Title Co. Title insurance in the full amount of the purchase price will be provided by the seller. The 2023 real estate taxes will be prorated to the date of closing. Title company closing costs will be divided equally between buyer & seller. Possession will be transferred to buyer at the time of closing. Farmland sells free of tenancy. Seller’s obligations hereunder are expressly conditioned and contingent upon approval of the sale of the property by the Probate Division of the Carroll County Circuit Court within 30 days of the date of the auction.

Announcements: This sale is subject to all easements, covenants, leases, and restrictions of record. Any announcements made auction day by Teter Auction Company will take precedence over any previously printed materials or oral statements. Bidding increments are at the sole discretion of the Auctioneer. No absentee or phone bids will be accepted at the auction without prior approval of the Auctioneer. All decisions of the Auctioneer are final.
